APA considers ACCC Final Determination Premature

The Australian Consumer and Competition Commission (ACCC) yesterday released its Final Determination on the Moomba to Sydney Pipeline Access Arrangement, notwithstanding the recent decision to deregulate part of the pipeline by the Minister for Industry, Tourism and Resources, Mr Ian Macfarlane.
Australian Pipeline Trust (APA) has previously advised the ACCC that it intends to submit a new access arrangement for the grid of the pipelines which remain covered. “The Minister’s decision has caused us to reconsider how a tariff structure might be applied to those regional pipelines which remain covered by the National Gas Access Code,” the Managing Director Mr Jim McDonald said.
APA believes the release of the Final Determination is premature.
Australian Pipeline Trust is considering its options to have the decision reviewed or withdrawn.
The majority of gas hauled through the Moomba to Sydney Pipeline is contracted and the Final Determination will not have any material impact on APT’s revenues for several years.
